s of December 2024, Wisconsin has legalized the cultivation and marketing of hemp products under the 2018 Farm Bill, provided they contain no more than 0.3% delta-9 THC. This federal legislation permits the production and sale of hemp-derived products, including CBD and other cannabinoids, across the United States.

In Wisconsin, the Department of Agriculture, Trade and Consumer Protection (DATCP) previously managed the hemp program. However, starting January 1, 2022, hemp growers transitioned to the U.S. Department of Agriculture (USDA) for licensing and oversight. Consequently, DATCP no longer issues hemp grower licenses. Despite this transition, DATCP continues to enforce regulations concerning the sale and labeling of hemp products within the state. Businesses marketing hemp-derived products in Wisconsin must adhere to the following guidelines:

  • Truth-In-Labeling: Businesses must avoid making inaccurate claims about the content, quality, or origin of hemp or hemp products. The "Growing Opportunities Act" prohibits knowingly making such false statements.

  • Method of Sale: Hemp products must be sold in accordance with the method of sale requirements specified by Wisconsin Administrative Code Chapters ATCP 90 and ATCP 91, and NIST Handbook 130.

  • Recordkeeping: Businesses are required to maintain records of hemp transactions, including; total quantity of hemp purchased and sold, names and addresses of suppliers and customers, and documentation of THC content for each batch. These records must be kept for a minimum of three years.

  • Compliance with Federal Regulations: In addition to state requirements, businesses must adhere to federal regulations set by the USDA, which oversees hemp production standards, including THC content testing and reporting.

  • Regulatory Adherence: Dispensaries must comply with all applicable state laws and regulations, including those related to labeling, packaging, and product testing.

  • Marketing & Advertising: While specific advertising regulations for hemp products in Wisconsin are not detailed, businesses should ensure that all marketing materials; do not make unsubstantiated health claims and comply with federal guidelines set by the Food and Drug Administration (FDA) regarding the marketing of hemp-derived products.
